Agreement & Definitions
By initiating a booking with us, you enter into a direct contractual agreement with Mamis Tours & Travels, hereinafter referred to as the “Company.” This agreement formally governs the relationship between the Company and you, the person or entity making the reservation, hereinafter referred to as the “Traveler.”
The term “Traveler” applies to the individual booking the tour as well as all members of their party. It is the primary booker’s responsibility to ensure all members of their group are aware of and accept these terms. Acceptance of this contract occurs immediately upon the payment of a deposit or the digital signing of a booking form. These terms constitute the entire agreement and supersede any prior discussions or representations.
Booking Process & Financial Terms
Deposit Requirement: A reservation is only considered confirmed and binding once the Company receives a non-refundable deposit of 30% of the total tour cost. This secures your vehicle, guide, and accommodation slots.
Balance Payment: The remaining balance must be cleared no later than 60 days prior to the scheduled departure date. Failure to pay by this deadline may result in the forfeiture of the deposit and cancellation of the booking.
Late Bookings: Reservations made within 60 days of the departure date require full payment immediately upon booking confirmation.
Payment Methods: We accept payments via bank wire transfer and major credit cards. Please note that credit card transactions may incur a surcharge to cover processing fees.
Currency: All pricing and payments are processed in US Dollars (USD) unless otherwise explicitly agreed upon in writing.
Traveler Responsibilities & Requirements
Documentation: Travelers must possess a passport valid for at least six months beyond the intended date of return.
Visas & Entry: Obtaining necessary entry visas for Kenya, Tanzania, or other East African nations is the sole responsibility of the Traveler. The Company is not liable for entry denials.
Mandatory Insurance: Comprehensive travel insurance is a requirement for booking. This must cover medical expenses, emergency repatriation/evacuation, trip cancellation, and baggage loss.
Health & Fitness: Travelers must be in good physical and mental health. Any pre-existing medical conditions or dietary restrictions must be disclosed in writing prior to booking.
Behavioral Conduct: The Traveler agrees to abide by the authority of the tour guide. Behavior that compromises the safety or well-being of the group may result in immediate removal from the tour without refund.
Liability, Risk & Third-Party Services
Safaris and adventure travel involve inherent risks, including but not limited to unpredictable wildlife behavior, rough terrain, and remote medical facilities. By booking, the Traveler acknowledges these risks and agrees that Mamis Tours & Travels assumes no liability for injury, death, illness, or loss of property resulting from these natural hazards.
The Company acts as an agent for third-party accommodations, airlines, and transport providers. Consequently, the Company cannot be held liable for delays, mechanical failures, overbooking, or service deficiencies caused by these independent operators. While we vet our partners rigorously, we do not control their daily operations. Any claims regarding third-party negligence must be directed to the specific provider involved.
